1. Acceptance of terms

These Terms of Service (this "Agreement") are entered into by Systematik ("we," "us," or "our") and the entity or individual executing this Agreement ("Customer" or "you"). This Agreement governs your use of the GA4 Audit Tool service (the "Service"). By accessing or using the Service, you acknowledge that you have reviewed and accept this Agreement. If you do not agree to these Terms, you may not use the Service.

2. Description of service

GA4 Audit Tool is a tool designed to analyze Google Analytics 4 (GA4) properties and generate health reports. The Service uses the Google Analytics Management API and Reporting API to audit your configurations against best practices.

2.1 License to use

Subject to the terms and conditions of this Agreement, we grant you a limited, revocable, non-exclusive, non-sublicensable license to use the Service to audit GA4 properties you own or manage. You may access, view, and download your Audit Reports stored at systematikdata.com (or our localized domains).

2.2 Restrictions

You will not (and will not allow any third party to): (i) reverse engineer, decompile, or attempt to discover the source code of the Service; (ii) use the Service to build a competitive product; (iii) use the Service for any illegal or unauthorized purpose; or (iv) interfere with the security or operation of the Service.

3. Data access & permissions

To provide the Service, we require access to your Google Analytics 4 data. You warrant that you have the legal right to disclose this data to us and to authorize us to process it for the purpose of generating audit reports.

We adhere to the Google API Services User Data Policy, including Limited Use requirements. We do not use your data for advertising purposes or share it with unauthorized third parties.

4. Fees and payment

Subscriptions: Determine your billing cycle (e.g., monthly). Fees are billed in advance. Your subscription will automatically renew unless canceled.

Cancellation: You may cancel your subscription at any time via your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

Non-Payment: If we are unable to charge your payment method, we may suspend your access to paid features until payment is received.

6. Limitation of liability

To the extent permitted by applicable law, Systematik will not be liable for your lost revenues, or indirect, special, incidental, consequential, exemplary, or punitive damages, even if we have been advised of the possibility of such damages. Our total cumulative liability to you for any loss or damages arising out of or relating to this Agreement will not exceed the amount you paid to us for the Service in the 12 months prior to the claim, or $500 USD, whichever is lower.

7. Indemnification

You agree to indemnify and hold harmless Systematik and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

8. Modifications

We may modify these Terms at any time. We will provide notice of significant changes. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
